TRAINING OBJECTIVES
The teaching is aimed at the acquisition of fundamental knowledge in the field of the right to the environment and environmental responsibility and intends to introduce to the study of environmental law. The objective is to provide adequate skills, useful for addressing and resolving issues ambientai practices in the course of professional experiences in national, supranational and international, public administrations, private enterprises.
RESULTES OF LEARNING ATTENDED
The discipline is aimed at allowing students to acquire knowledge of the general notions of private environmental law and to allow the in-depth analysis of the main problems that the theme poses. In particular, the student:
KNOWLEDGE AND CAPACITY OF UNDERSTANDING
- Knows the general issues of protection and safeguard of the environment, sustainability, the relationship between the environment and the market and the responsible use of natural resources.
- Knows the issues of internal and community regulatory sources, subjective legal situations, contracts, civil liability; knows the main sources of environmental law, in particular the discipline of environmental damage; has knowledge of the main orientations of the jurisprudence, national and European, on the most relevant environmental issues of the last years.
- Includes issues related to issues of regulatory, internal and community sources, and their relationship, with particular reference to environmental issues; it includes the concept of fair and sustainable well-being and the problems connected with the relationship between production systems, the environment and civil liability.
- Understand the difference between the cases and has full understanding of the legal instruments necessary to meet the needs coming from the social reality and the economic world, such as, for example, the different disciplines dictated in application of the principles of prevention, precaution, correction at the source of the environmental damage or, again, the ecological contract.
KNOWLEDGE AND CAPACITY OF UNDERSTANDING (applied)
- uses the knowledge acquired by applying it in the qualification of a specific case; is able to frame the types of pollution in light of the "polluter pays" principle;
- selects the legal instruments necessary to meet the needs coming from the social and economic reality, such as, for example, the compensation techniques for environmental damage;
- formulates an elementary legal opinion on issues pertaining to environmental problems, with particular reference to the relationship between the company and the market and to the problems of pollution deriving from production processes.
AUTONOMY OF JUDGMENT
- Interprets a text of the law, in appreciation of the legal consequences deriving from certain behaviors and relations between private individuals
- Expresses analytical and summary considerations on the fundamental aspects of the discipline and makes connections between the various institutes.
- Interprets the concrete cases that the reality of relations between the state, private individuals and the environment presents (for example, pollution of sites, damage to the environment and people,) with legal instruments, estimating their consequences (for example, compensation for damage, environmental repair ).
- Applies the notions acquired to the specific cases and able to indicate the preferable solution and to orientate among several proposed solutions.
